These Terms and Conditions describe the rules and regulations for using the Helios application and website, operated by Achaia Labs (“we”, “us”, or “our”).
Acceptance of Terms
By accessing or using Helios, you agree to these Terms and Conditions. If you do not agree, do not use the app or related services.
Description of Service
Helios provides prompts and related inspiration for generating images and videos, along with related features, community content, and subscription-based premium access.
Eligibility and Accounts
You may need to create an account to use some features. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Subscriptions and Billing
Helios may offer paid subscriptions, including monthly and yearly plans. Pricing, taxes, billing timing, renewal details, and any plan-specific benefits will be shown in the app, on the website, or during checkout. By starting a subscription, you authorize recurring charges until you cancel.
Cancellation and Refunds
You can cancel a subscription through the platform used to purchase it or through the cancellation method shown in the app or website. Cancellation stops future renewals, but access continues until the end of the current billing period unless stated otherwise at checkout. Refunds, if any, are handled according to the relevant payment platform's rules and applicable law.
User Content
You retain ownership of the content you submit. By submitting content, you grant Achaia Labs a limited, worldwide, non-exclusive, royalty-free license to host, process, display, reproduce, and use that content only as needed to operate, improve, and support Helios.
Outputs and Responsibility
Prompts, suggestions, and generated results may not always be accurate, complete, suitable, or free from errors. You are responsible for reviewing outputs before relying on, publishing, or sharing them. You are also responsible for ensuring that your use of Helios and any output complies with applicable laws, third-party rights, and platform rules.
Acceptable Use
You agree not to use Helios to create, request, upload, or distribute unlawful, harmful, abusive, defamatory, infringing, misleading, or prohibited content. You agree not to interfere with the app, attempt unauthorized access, scrape the service, reverse engineer any protected part of the app except where permitted by law, or use the service to violate the rights of others.
Intellectual Property
Helios, including its design, branding, features, software, and related materials, is owned by Achaia Labs or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the service unless we expressly allow it or the law permits it.
Third-Party Services
Helios may rely on or link to third-party services, such as app stores, analytics providers, cloud providers, or payment processors. We are not responsible for third-party content, policies, availability, or practices.
Suspension and Termination
We may suspend or terminate your access to Helios if you violate these Terms, create risk for the service or other users, or use the app in a way that may cause legal, security, or operational harm.
Disclaimers
Helios is provided on an as-is and as-available basis. To the fullest extent permitted by law, Achaia Labs disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, error-free, or that generated results will meet your expectations.
Limitation of Liability
To the fullest extent permitted by law, Achaia Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, business opportunities, or other intangible losses arising from or related to your use of Helios.
Indemnity
You agree to indemnify and hold harmless Achaia Labs and its affiliates, officers, employees, and partners from claims, damages, liabilities, costs, and expenses arising out of your misuse of Helios, your content, or your violation of these Terms or applicable law.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date and may provide notice where appropriate. Continued use of Helios after the updated Terms become effective means you accept them.
